In cases of ordinary negligence we are liable only for breach of a material contractual obligation, meaning an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely. In such cases liability is limited to the foreseeable damage typical for this type of contract.
Any liability beyond this is excluded.
Governing law and place of jurisdiction
These Terms and Conditions are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident outside Germany, the mandatory protective provisions of your country of residence remain unaffected.
Where the contracting party is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship is our registered office in Berlin. For consumers, the statutory places of jurisdiction apply.
Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Severability
Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected.
Changes to these terms
We may update these Terms and Conditions from time to time. Changes will be published on this page with an updated effective date. For contracts already concluded, the version in force at the time of conclusion applies.
